Terms of Service

Welcome to Continuity.

Continuity is a daily detective puzzle game operated by Projevity Pty Ltd (ACN 696 573 154) ("Projevity", "we", "our" or "us").

By downloading, accessing or using Continuity, you agree to these Terms of Service. If you do not agree with these Terms, please do not use Continuity.

1. The service

Continuity provides a puzzle game featuring nightly cases, a weekly story with a casebook, hunches and bets made with virtual points, progression, badges, personal statistics and community statistics.

The game may be updated, modified, suspended or discontinued from time to time.

2. Eligibility

You must be at least 13 years old, or the age of digital consent in your country if higher. If you are under 18, you need a parent or guardian's permission. You are responsible for ensuring that your use of Continuity is lawful in your jurisdiction.

If you create an account, you agree to provide accurate information and to keep your account secure.

3. Guest play

Continuity may be used without an account. Guest progress is stored locally on your device.

We cannot guarantee that locally stored guest progress will survive app deletion, clearing app data, device failure, device replacement, operating system changes or other events outside our reasonable control. Creating an account provides access to cloud-based account functionality.

4. Accounts

You are responsible for the security of your account. You must not impersonate another person, create accounts for fraudulent purposes, attempt to access another user's account, or manipulate the service to obtain an unfair advantage.

We may suspend or terminate accounts involved in abuse, fraud, cheating or material violations of these Terms.

5. Fair play

Continuity is intended to be played fairly. You must not:

6. Community statistics and leaderboards

Where community statistics or leaderboards are available, they are based on legitimate gameplay results and may change as more results are submitted. We may remove results that we reasonably determine are fraudulent, technically invalid or obtained through exploitation.

7. Nightly and weekly cases

Nightly and weekly cases follow the calendar and may present the same case to all players on a given day. Availability, rules and difficulty may change, and we do not guarantee uninterrupted availability of any particular case.

8. Progression, badges, points and bets

Continuity may provide ranks, badges, scores, hunches and leader bets. These are gameplay features made with virtual points. They have no monetary value, cannot be exchanged for money, goods, services or other consideration, and involve no real-money gambling.

Progression may be adjusted if a result is determined to be invalid.

9. Advertising

Continuity does not display third-party advertising.

10. No purchases or subscriptions

Continuity does not currently offer subscriptions, virtual currencies, paid gameplay advantages, paid progression, loot boxes or energy systems. If these features are introduced in the future, appropriate terms and disclosures will be provided before they are offered.

11. Intellectual property

Continuity, including its software, game design, cases, visual design, branding, text, graphics and other original content, is owned by or licensed to Projevity Pty Ltd unless otherwise stated.

You may use Continuity for personal, lawful entertainment purposes. You may share your own results and screenshots of your own gameplay. You may not reproduce, distribute, sell, modify or exploit the App or its proprietary content without permission.

12. Fiction

All cases, characters, places and events in Continuity are fictional. Any resemblance to real people or events is coincidental.

13. User feedback

If you provide feedback, suggestions or ideas about Continuity, you agree that Projevity may use that feedback to improve the service without owing you compensation, provided that doing so does not violate applicable law.

14. Third-party services

Continuity may rely on third-party services such as hosting providers, authentication providers (including Apple) and app stores. Your use of those services may also be subject to their respective terms and privacy policies.

15. Availability

We aim to keep Continuity available and reliable, but we do not guarantee that the App will always be available, be error-free, operate without interruption, be compatible with every device or preserve guest data under all circumstances. We may perform maintenance or make changes to the service.

16. Disclaimer

To the maximum extent permitted by law, Continuity is provided on an "as available" basis. Nothing in these Terms excludes consumer guarantees, rights or remedies that cannot legally be excluded under applicable law, including the Australian Consumer Law.

17. Limitation of liability

To the maximum extent permitted by law, Projevity Pty Ltd will not be liable for indirect, incidental, special or consequential loss arising from your use of Continuity. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

18. Account termination

You may delete your account at any time through the App or through https://continuity.projevity.com.au/delete-account.

Projevity may suspend or terminate accounts where reasonably necessary due to fraud, cheating, abuse, unlawful conduct, security threats or material breach of these Terms. Where appropriate, we will provide notice.

19. Apple App Store

If you obtained Continuity from the Apple App Store: these Terms are between you and Projevity, not Apple. Apple has no obligation to provide support or maintenance for the App, and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to Continuity

We may modify gameplay, features, systems, visual elements or other aspects of Continuity from time to time, and may introduce or remove features.

21. Changes to these terms

We may update these Terms from time to time. Where material changes are made, we may provide reasonable notice through the App or another appropriate method. Continued use of Continuity after updated Terms take effect constitutes acceptance of the updated Terms, to the extent permitted by law.

22. Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the applicable courts and tribunals of Queensland, Australia, subject to any mandatory consumer protection rights that apply to you.
